1. Agreement to Terms

By accessing our website or using the services of Elite Roofing Company LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you do not agree with any of these terms, you are prohibited from using or accessing our services. The materials and services provided by Elite Roofing Company LLC are protected by applicable copyright and trademark law.

2. Services Description

Elite Roofing Company LLC provides professional roofing services including but not limited to:

• Residential and commercial roofing installation
• Roof repair and maintenance
• Emergency roofing services
• Roof inspections
• Storm damage assessment and repair
• Insurance claim assistance
• Gutter installation and repair

All services are subject to availability and scheduling. We reserve the right to refuse service to anyone for any reason at any time.

3. Estimates and Pricing

Free Estimates

We provide free estimates for our services. Estimates are based on visual inspection and information provided by the customer. Estimates are valid for 30 days from the date of issuance unless otherwise specified.

Final Pricing

Final pricing may vary from the initial estimate if:

• Additional damage is discovered during work
• Customer requests changes to the scope of work
• Unforeseen complications arise
• Material prices change significantly

Any changes to pricing will be communicated to the customer for approval before proceeding.

4. Payment Terms

Payment Schedule

Payment terms are as follows:

• Emergency services: Payment due upon completion
• Minor repairs (under $1,000): Payment due upon completion
• Major repairs/installations: 50% deposit upon contract signing, balance due upon completion
• Insurance claims: Payment due upon insurance settlement

Accepted Payment Methods

We accept the following payment methods:

• Cash
• Check
• Credit/Debit cards
• Financing (subject to approval)
• Insurance proceeds

Late Payments

Accounts not paid within 30 days of invoice date may be subject to a late fee of 1.5% per month. We reserve the right to pursue collection for unpaid balances.

5. Warranties and Guarantees

Workmanship Warranty

We provide the following warranties on our workmanship:

• Repairs: 5-year warranty
• New installations: 10-year warranty
• Emergency repairs: 1-year warranty

Material Warranties

Material warranties are provided by the manufacturer and vary by product. We will assist with warranty claims but are not responsible for manufacturer defects.

Warranty Exclusions

Our warranties do not cover:

• Damage from acts of God, war, or terrorism
• Damage from lack of maintenance
• Damage from modifications by others
• Normal wear and tear
• Damage from building settling or structural issues

6. Limitations of Liability

In no event shall Elite Roofing Company LLC or its employees be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount paid by the customer for the specific service that gave rise to the claim.

7. Customer Responsibilities

As our customer, you agree to:

• Provide accurate information about your property and roofing needs
• Ensure safe access to work areas
• Remove or protect valuable items near work areas
• Make timely payments according to agreed terms
• Maintain the roof according to our recommendations
• Promptly notify us of any issues or concerns

8. Cancellation Policy

Customer Cancellation

Customers may cancel services:

• Without penalty if cancelled 48 hours before scheduled work
• With a cancellation fee of $250 if cancelled within 48 hours
• Deposits are non-refundable for custom-ordered materials

Company Cancellation

We reserve the right to cancel or reschedule services due to:

• Unsafe weather conditions
• Unsafe working conditions
• Customer non-payment
• Material unavailability

9. Property Access and Safety

By engaging our services, you grant us permission to:

• Access your property during agreed-upon hours
• Use utilities (water, electricity) as needed for work
• Place equipment and materials on your property
• Take photographs for documentation purposes

We will take reasonable precautions to protect your property but are not responsible for pre-existing conditions or hidden defects.

10. Insurance and Claims

Our Insurance

Elite Roofing Company LLC maintains:

• General liability insurance: $2,000,000
• Workers' compensation insurance as required by law
• Commercial auto insurance

Customer Insurance Claims

We provide assistance with insurance claims but:

• Cannot guarantee claim approval or amount
• Are not responsible for insurance company decisions
• May require payment regardless of insurance outcome

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through the following process:

1. Direct negotiation between parties
2. Mediation through a mutually agreed mediator
3. Binding arbitration under the rules of the American Arbitration Association

The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees and costs.

12. Termination

These Terms remain in effect until terminated by either party. You may terminate by discontinuing use of our services. We may terminate immediately if you violate any provision of these Terms.

Upon termination, all payment obligations and warranty provisions shall survive.

13. Intellectual Property

All content on our website and materials provided during service, including but not limited to text, graphics, logos, images, and software, are the property of Elite Roofing Company LLC and protected by copyright laws.

You may not reproduce, distribute, or create derivative works without our express written permission.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any legal action or proceeding shall be brought exclusively in the courts of Miami-Dade County, Florida.

15. Contact Information

These Terms of Service are effective as of January 2, 2025 and supersede all prior versions. We reserve the right to update these Terms at any time, and will notify customers of material changes.
